1. INTRODUCTION
1.1 These terms (the "Terms") govern the use of the crewfiction platform, as well as the products, services and features that make part of the platform (collectively, the “Service”). By accessing or using the Service, you agree to comply with, and be legally bound by, the provisions of these Terms. These Terms govern your access to and use of the Services and constitute a binding legal agreement between you and CR3W, Inc (“CR3W”).
1.2 The Service allows users to share, discover, and read books, stories, and other content online. crewfiction provides a comprehensive platform where content creators ("Authors") can list, publish and promote their works, content promoters ("Publishers") can discover and market literary content, and potential readers ("Readers") can access a curated library of fiction. The Service includes author tools for publishing and marketing, publisher resources for content promotion and distribution, and reader features for discovering and enjoying books. For the purposes of these Terms, Authors, Publishers, and Readers shall collectively be referred to as "Users."
1.3 Modification. CR3W reserves the right, in its sole discretion, to modify these Terms at any time. Any amendment to the Terms will be notified to Users in accordance with the requirements of applicable law.
2. AVAILABILITY, CHANGE AND DISCONTINUATION OF THE SERVICE
2.1 Users have no claim for uninterrupted availability of the Service. However, CR3W will make every effort to achieve the highest possible level of availability and to deal with any interruptions in the provision of the Service as soon as possible.
2.2 CR3W reserves in any case the right to temporarily or permanently interrupt the availability of any part of the Service. In such instances, CR3W will make every effort to duly inform Users prior to any interruption of the availability of part or all of the Service, unless prevented from doing so by an urgent need to suspend the Service, e.g. preventing abuse or harm, responding to legal requirements, or addressing security and operability issues.
2.3 CR3W shall have the right to modify the Service at any time in a manner that is reasonable for the User, for example, in order to make quality improvements to the Service.
3. ELIGIBILITY, REGISTRATION, PAYMENT
3.1 The Service is intended solely for Users who are fifteen (15) years of age or older. Use of the Service by anyone that does not meet these eligibility requirements is expressly prohibited.
3.2 To access the Service, Users must create an account with CR3W and register as a "Reader," "Author," or "Publisher." During the registration process, Users are required to provide a username, email address, and password. Users may also be asked to provide additional information such as professional details, business preferences, marketing practices, and other relevant information to enhance their experience on the Service. Users may alternatively sign in via a third-party service (such as Apple or Google).
3.3 CR3W may charge one-time or recurring fees for access to certain features or content of the Service (“Paid Service”). Users will be informed in advance of the fee amounts and payment methods through the Service. For recurring fees, any changes in pricing made by CR3W will only apply following reasonable notice to the affected Users. If a User does not wish to continue their subscription to a Paid Service following a change in pricing, they may cancel before the start of the next subscription period in which the new price applies.
CR3W accepts payment via the method indicated at purchase. A valid payment method is required for the Paid Service, including free trials. Users agree to pay for any Paid Service order, and CR3W will charge their payment method accordingly. For auto-renewing subscriptions (recurring fees), CR3W will charge the stored payment method at the start of each billing period. If a payment fails due to an expired card or other issue, access may be restricted until the User updates their payment method. Where possible, CR3W will notify the User; failure to update within a reasonable time may result in subscription cancellation.
3.4 CR3W may occasionally offer free trials for a Paid Service. Users that purchase a subscription to a Paid Service that includes a trial, will have access to that Paid Service for the trial period. Unless canceled beforehand, the subscription will automatically convert to a paid plan, and the User will be charged the price of the subscription until they cancel (see below clause “Termination or Withdrawal by User”).
3.5 If CR3W is obligated to collect or remit taxes on a User's purchase of a Paid Service, the applicable taxes will be added at the time of the transaction.
4. ACCOUNT ACTIVITY
4.1 Users agree to always use their CR3W account and the Services in compliance with these Terms, applicable law, and any other policies and standards provided to them by CR3W.
4.2 Users agree to take sole responsibility for all activity that occurs through their CR3W account.
4.3 Users are responsible for keeping their CR3W account credentials secure from third parties, and shall report any actual or suspected unauthorized use of their account. In case of failure to comply with this obligation, the User shall be fully responsible for any actions of third parties occurring through their account.
5. USE OF THE SERVICE
5.1 Content. The content on the Service includes books, stories, catalogues, scripts, graphic novels and other text-based media (collectively, "Content”). Content may be provided to the Service by Authors, Publishers and distributed by any User. CR3W is a provider of hosting services for such Content.
5.2 License. Subject to compliance with these Terms, CR3W grants Users a limited, revocable, non-exclusive, non-transferable license, to access and view any Content to which they are permitted access, solely for their personal and non-commercial purposes. Users shall not sublicense the rights granted in this section. Except for the licenses and rights expressly granted in these Terms, Users are not granted any other licenses or rights to any IP rights owned or controlled by CR3W or its licensors.
5.3 Marketing tools. The Service may provide Authors and Publishers with a range of tools that facilitate the distribution and marketing of Content (“Marketing Tools”). Authors and Publishers may use such Marketing Tools to establish their online presence, expand their fanbase, gather email subscribers, including by generating promotional material and reaching Users interested in specific types of Content. Users retain ownership of content created with Marketing Tools, but grant CR3W a non-exclusive, royalty-free license to use such content solely to provide and improve the Service.
5.4 Third-Party Links. The Service may include links to third-party websites and online services that are not owned or controlled by CR3W. Users accessing these third-party platforms are subject to their respective terms of service. CR3W assumes no responsibility for the content, policies, or practices of any third-party websites or services.
5.5 Restrictions: Use of the Service and access to Content are subject to certain restrictions. Specifically, Users are not allowed to:
(i) commercially exploit, redistribute for profit, or mass distribute any part of the Service or its Content without explicit authorization from rights holders and CR3W, except for permitted personal uses including:
- Downloading books to personal devices for individual reading
- Reading books offline through the crewfiction mobile app
- Sharing brief excerpts (under 500 words) for review, commentary, or promotional purposes
- Authors and Publishers sharing their own uploaded content on other platforms
(ii) share with other Users Content that violates these Terms, applicable laws, or infringes on third-party rights;
(iii) circumvent, disable, or interfere with the Service's security measures, digital rights management systems, or features designed to protect Content;
(iv) use automated tools (including bots, scrapers, or bulk downloading software) to access, extract, or download Content without prior written authorization from CR3W;
(v) distribute spam, unsolicited promotions, or mass solicitations through the Service, except as specifically permitted by CR3W's marketing guidelines;
(vi) manipulate engagement metrics (including reviews, ratings, follows, or other user interactions) or create fake accounts to artificially influence the Service;
(vii) misuse reporting systems by submitting false, frivolous, or bad-faith claims against other Users or Content;
(viii) violate applicable laws or regulations, including but not limited to copyright, trademark, privacy, and data protection laws;
(ix) post false, misleading, defamatory, or harmful content, including impersonating others or making unauthorized claims about affiliation with CR3W or third parties;
(x) harm, threaten, harass, or intimidate other Users, or engage in conduct that creates an unsafe or unwelcoming environment;
(xi) attempt to damage or negatively impact the crewfiction brand, CR3W's reputation, or business operations through coordinated attacks, false claims, or malicious activities;
(xii) reverse engineer, decompile, or attempt to derive source code from the Service or any proprietary technology used by CR3W;
(xiii) actively recruit Users to join competing services or platforms without CR3W's prior written consent, though incidental mentions in non-commercial contexts are permitted.
Permitted Uses: Nothing in this clause restricts Users from:
- Normal reading and personal enjoyment of Content
- Legitimate criticism, commentary, or discussion about books and authors
- Fair use under applicable copyright laws
- Authors' and Publishers' rights to promote their own works
- Reasonable sharing of recommendations with friends and family
6. USER-GENERATED CONTENT
6.1 Uploading content. Users that have registered as “Authors” and “Publishers” will be able to upload Content to the Service.
6.2 Responsibility. Authors are legally responsible for the Content they upload to the Service.
6.3 Restrictions. Any Content uploaded to the Service must comply with these Terms and the law. Particularly, Authors and Publishers are not allowed to submit or distribute Content which:
(i) violates applicable laws or regulations;
(ii) copies or reproduces copyrighted works, or otherwise infringes on third-party intellectual property, without proper authorization;
(iii) promotes hate, violence, or discrimination based on race, ethnicity, nationality, gender, religion, disability, sexual orientation, or any other protected characteristic;
(iv) intimidates, bullies, stalks, or threatens harm to any individual or group;
(v) contains deliberately misleading information, hoaxes, false claims, or content that damages someone’s reputation;
(vi) sexualizes, exploits, or endangers minors;
(vii) glorifies or encourages self-harm, suicide, or disordered eating behaviors;
(viii) advocates, promotes, or instructs on illegal actions, including drug use, fraud, hacking, or criminal conduct;
(ix) contains false claims of identity, misleading affiliations, or deceptive practices;
(x) supports, incites, or glorifies extremist ideologies, radicalization, or terrorist acts;
(xi) publishes personal or confidential information without consent, including addresses, phone numbers, or financial details;
(xii) glorifies, promotes, or describes harm to animals in a gratuitous manner;
(xiii) contains links, files, or references designed to spread malware, phishing, or cyber threats;
(xiv) or contains repetitive, low-quality, or mass-produced AI-generated content that lacks originality or authenticity.
6.4 Reporting and identification of non-compliant Content. If a User sees any Content they believe does not comply with these Terms, they can report it to CR3W. In addition, CR3W may use automated systems that analyze User-generated Content to help detect instances of non-compliance.
7. RIGHTS OVER USER-GENERATED CONTENT
7.1 Authors retain all ownership rights in the Content they upload to the Service.
7.2 To allow for the proper activity and development of the CR3W community, Authors grant the following licenses in relation to the Content they upload to the Service:
(i) a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to CR3W to reproduce, distribute, modify, display and/or perform that Content for the purpose of operating, promoting, and improving the Service;
(ii) a worldwide, non-exclusive, royalty-free license to each other User to access that Content through the Service, and to use it only as enabled by a feature of the Service (e.g. to reproduce, distribute, modify, display, and/or perform that Content, as applicable).The above licenses shall remain in effect until the Content is removed for any reason from the Services. However, by exception, the licenses will continue beyond removal if necessary for the operation of the Service, or to enable permitted use of the Content prior to removal, or as required by law.
8. REMOVAL OF CONTENT
8.1 Removal by Author. Authors may remove any Content they have uploaded to the Service at any time. Removal is necessary when the Content ceases to comply with these terms (e.g., a new law renders the content illegal). By exception, Authors may not remove Content that they have licensed to another User/a Publisher.
8.2 Removal of content by CR3W. Where CR3W has reason to believe that any of the Content uploaded by an Author is in breach of these Terms, it reserves the right to remove or take down some or all of such Content. Authors or Publishers will be notified of the removal or take down, as well as of their right to appeal CR3W’s decision, unless such notification could potentially (a) risk legal liability for CR3W, (b) harm CR3W, any of its affiliates or Users, (c) compromise any aspect of the Service or (d) compromise an investigation.
9. LIMITATION OF LIABILITY
9.1 To the fullest extent permitted by law, CR3W and its affiliates, directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from or related to:
(i) Users' access to or use of (or inability to access or use) the Service;
(ii) Any content uploaded, posted, or otherwise made available through the Service by any User or third party;
(iii) Any unauthorized access to or use of CR3W’s servers and/or any personal or financial information stored therein;
(iv) Any interruption, suspension, modification, or termination of the Service;
(v) Any errors, bugs, viruses, or other harmful components transmitted through the Service by any User or third party.
9.2 In no event shall CR3W’s total liability, whether in contract, tort (including negligence), or otherwise, exceed the amount paid by a User for their subscription in the 12 months preceding the event giving rise to the claim. If no payments have been made, CR3W’s liability shall be limited to the maximum extent permitted by applicable law.
9.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
10. TERMINATION OR WITHDRAWAL BY USER
10.1 Users may stop using the Service and terminate their CR3W account at any time, without giving reasons and without any charge. For subscriptions to a Paid Service, termination will take effect at the end of the billing period in which the termination request was made. Users will retain access to the Paid Service until then, but no refunds or credits will be provided for any unused days in the billing period.
10.2 Notwithstanding the above, Users residing in the European Economic Area (EEA), have the right to withdraw from their subscription to Paid Services within 14 days from the date of purchase, without providing any reason. To exercise such right, Users must inform CR3W of their decision through a clear statement (e.g., via email or an online withdrawal form, if available).
10.3 Withdrawals occurring within the 14-day period will receive a refund for all payments made to CR3W until the date of withdrawal, using the same payment method used for the original transaction, unless otherwise agreed.
11. SUSPENSION OR TERMINATION BY CR3W
11.1 CR3W may suspend or terminate a User’s access to all or part of the Service (including any Paid Service) if they materially or repeatedly are in breach of these Terms, or if it is investigating suspected misconduct. The suspension of termination will take immediate effect. No refunds or credits will be provided for any unused days in the billing period of a Paid Service.
11.2 The User will receive prior notice of the intended suspension or termination unless such notification could (a) risk legal liability for CR3W, (b) compromise an investigation or (c) harm the Service or any User.
11.3 Any decision by CR3W to suspend or terminate a User’s access to the Service will be substantiated, and can be appealed through appropriate channels provided by CR3W.
12. EFFECTS OF TERMINATION
12.1 Termination of access to the Service will not relieve the User of its obligations created prior to termination.
12.2 Upon termination, Authors may remove their uploaded books and stories from the platform. CR3W retains the right to keep non-personal information, user reviews, and community interactions, but will not continue distributing the Author's creative works without permission.
12.3 Termination of these Terms will have no effect on the releases, waivers or limitations of liability, or litigation provisions contained herein, nor any fees due, and all such clauses will survive the termination.
12.4 Upon termination, Authors and Publishers may no longer access CR3W's Marketing Tools, but retain the right to use promotional materials they created, provided such use does not misrepresent their continued relationship with CR3W or damage CR3W’s reputation or crewfiction's brand.
13. OTHER LEGAL MATTERS
13.1 Violations. CR3W reserves the right, but not the obligation, to investigate, take legal action, or refer any violations of these Terms to law enforcement or relevant authorities. Such actions may include prosecution, litigation, or other legal remedies to the fullest extent permitted by law.
13.2 Policy Enforcement. When addressing potential violations, CR3W may take into account a User’s performance history and the specific circumstances of each case. At its sole discretion, CR3W may choose to apply leniency in policy enforcement where appropriate, ensuring a fair and context-sensitive approach.
13.3 Communications with Users. Users acknowledge and agree that CR3W may contact them through electronic means (e.g., email, app notifications) as necessary to administer these Terms and comply with applicable laws. Where required, CR3W will obtain User consent for such communications, and Users retain the right to revoke their consent at any time.
14. FINAL PROVISIONS
14.1 Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the extent permitted by law to best accomplish the original intent of the Terms.
14.2 Assignment. Users may not assign, transfer, or delegate any of their rights or obligations under these Terms without prior written consent from CR3W. However, CR3W may assign or transfer its rights and obligations under these Terms, in whole or in part, to any of its affiliates or in connection with a merger, acquisition, sale of assets, or other similar corporate transaction.
14.3 No Waiver. Failure by CR3W to enforce any provision of these Terms shall not be construed as a waiver of its right to enforce such provision or any other provision in the future. Any waiver must be expressly stated in writing.
14.4 Governing Law and Jurisdiction. These Terms shall be governed by and interpreted in accordance with:
(i) The laws of the United Kingdom if the User is a resident of the UK;
(ii) The laws of the User’s country of residence if the User is a resident of the European Economic Area (EEA);
(iii) The laws of the State of Delaware, USA, in all other cases.
Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts corresponding to the applicable governing law, unless otherwise required by mandatory consumer protection laws.
14.5 Entire Agreement. These Terms, along with any other referenced policies, constitute the entire agreement between CR3W and Users, superseding any prior agreements or understandings, whether written or oral, relating to the Service.
